Job Specification

CONTRACT COMPLIANCE REPRESENTATIVE  

DEFINITION:

Under direction, performs field and/or office work and research involved in inspecting, investigating, and monitoring contracted goods and services to ensure compliance with terms of the contract and/or relevant laws, rules, and regulations and review contract violation complaints; does other related duties as required.

Monitors varied contracted goods and services for compliance with government regulations.

May receive and review complaints regarding vendors' contractual violations.

Observes conditions and conducts interviews to gather facts relating to alleged violations or discrepancies.

Gathers information and examines records and documents to establish facts and verify data.

May provide recommendations regarding appropriate resolution of the complaint.

May recommend legal or administrative action.

Prepares correspondence and reports of investigations for use by legal authorities.

May compile statistical data.

Interprets basic laws and regulations.

Maintains liaison with federal and state government representatives and keeps abreast of new and revised legislation.

May monitors progress of contractors, usually through reports.

Submits requests from contractor for deviation from contract specifications and terms to supervisor for approval.

Reviews contractors¿ performance for compliance with specifications and terms of the contract.

Recommends payment or nonpayment to contractor according to whether terms of the contract have been met by the contractor.

May recommend price redetermination or remuneration from the contractor when the jurisdiction/agency has suffered a loss or been inconvenienced because the contractor failed to meet terms of the contract. If required, recommends changes to the basic contract.

May conducts meetings and conferences with contractors to clarify issues on contractual requirements.

Monitors contractor performance through onsite inspections, telephone conversations, correspondence, and visits for compliance with applicable laws, delivery schedules, payment provisions, inspections, and other requirements as stated in the contract.

Provides guidance to contractor concerning obligations to perform within contractual terms.

Reviews and analyzes circumstances, and recommends solutions.

Recommends issuing show-cause notices when the contractor is not in compliance with contract provisions.

Investigates circumstances to determine alternative courses of action.

May serve legal papers to contractor for noncompliance with terms of contract.

Inspects work performed by contractors to ensure conformance with laws and regulations, and compliance with contractual provisions.

Prepares reports. Receives complaints regarding performance of contractual services, advises contractor representative of action needed, and reports on their resolution of the complaint.

Maintains records and files, and other historical information regarding complaints.

Will be required to learn to utilize various types of electronic and/or manual recording and information systems used by the agency, office, or related units.

REQUIREMENTS:

NOTE: Applicants must meet one of the following or a combination of both experience and education. Thirty (30) semester hour credits are equal to one (1) year of relevant experience.

Five (5) years of professional experience in ensuring compliance with terms of contracts, negotiating with vendors to resolve problems of contractual obligation, and determining the course of action needed for compliance with contract provisions.

OR

Possession of a bachelor's degree from an accredited college or university; and one (1) year of the above-mentioned professional experience.

NOTE: "Professional experience" refers to work that is analytical, evaluative, and interpretive; requires a range of basic knowledge of the profession's concepts and practices; and is performed with the authority to act and make accurate and informed decisions.

LICENSE:

Appointees will be required to possess a driver's license valid in New Jersey only if the operation of a vehicle, rather than employee mobility, is necessary to perform the essential duties of the position.

KNOWLEDGE AND ABILITIES

Knowledge of methods used to collect and analyze data.

Knowledge of contract compliance principles and practices. Knowledge of the methods used to monitor contract performance.

Knowledge of specific contractual requirements, terms, conditions, and provisions.

Ability to recognize and identify those factors which represent noncompliance.

Ability to recommend solutions to complaints.

Ability to maintain cooperative relationships with varied individuals including contractors and representatives of federal, state, and local governments.

Ability to collect and analyze data.

Ability to comprehend, analyze, and interpret basic laws and regulations.

Ability to inspect records, and other documents to determine compliance with regulations.

Ability to utilize various types of electronic and/or manual recording and information systems used by the agency, office, or related units.

Ability to read, write, speak, understand, and communicate in English sufficiently to perform duties of this position. American Sign Language or Braille may also be considered as acceptable forms of communication.
