Job Specification

COMPLIANCE OFFICER 1 CODE ENFORCEMENT

DEFINITION:
                                                          
Under direction of the Compliance Officer 2 Code Enforcement, or other 
supervisory official, 

i.   In the Division of Codes and Standards, Department of Community 
Affairs, performs the work involved to ensure compliance with the New Jersey 
Hotel and Multiple Dwelling Laws and regulations by property owners who 
have not voluntarily complied with abatement-of-violation orders; OR
 
ii.  In the Division of Fire Safety, Department of Community Affairs,
performs the work to ensure compliance with the New Jersey Uniform Fire 
Safety  Act, Fire Safety Code, Fire Prevention Code and related regulations 
by property and/or business  owners who have not voluntarily complied with 
abatement-of-violation order; OR

iii.  In the Department of Labor and Workforce Development performs 
the work involved to ensure Compliance with the New Jersey Crane 
Operators Act and the Asbestos Control and Licensing Act; does 
other related duties.

NOTE:  The examples of work for this title are for illustrative purposes only. 
A particular position using this title may not perform all duties listed in this 
job specification. Conversely, all duties performed on the job may not be 
listed.

EXAMPLES OF WORK:

General:

Reviews and evaluates cases of non-compliance and assesses penalties.

Coordinates enforcement efforts with other agencies.

Gathers information and documentation used to prepare docketed judgments.

Prepares documentation for stipulatory agreements needed for hearings; 
reviews documents prepared by code enforcement staff.

Identifies and refers cases of habitual offenders.

Reviews property files to determine if proper service of process has been 
made; takes remedial action as required.

Meets with property or business owners or their representatives.

Monitors the progress of investigations of assigned cases; provides 
recommendations for final disposition of settlement, hearing, judgment 
or dismissal.

Reviews files in response to requests for extensions, exceptions and 
administrative hearings, determines whether request should be approved 
or conducts further investigation.

Determines length of time permitted for the abatement of violations; 

Prepares abatement schedules and extensions.

Negotiates to settle claims and/or appeals, penalties or violations.

Establishes and maintains cooperative working relationships with those 
interested or involved in the work of the program.

Speaks before various groups, property or business owners and other 
interested parties to explain laws, rules and regulations.
 
Appears as a witness and provides testimony in court.

Prepares correspondence and reports.

Establishes and maintains records and files.

Will be required to learn to utilize various electronic and/or manual 
recording and information systems used by the agency, office or 
related units.

NOTE:  The following are for positions assigned to the Division of Codes 
and Standards, Department of Community Affairs:

Interprets the New Jersey Hotel and Multiple Dwelling Laws and Regulations 
to property owners or their representatives.

Reviews property files to determine what actions are necessary to ensure 
that properties meet the requirements of the New Jersey Hotel  and Multiple 
Dwelling Act and regulations.

NOTE:  The following are for positions assigned to the Division of Fire Safety, 
Department of Community Affairs:

Investigate inspection appeals, determine validity of violations written.

Work with business owners’ representatives to create abatement 
plans if warranted

Investigate registration appeals, explain findings to business owner 
and/or representative

Correct business registrations in the division’s Registration and Inspection 
Management System (RIMS)

Investigate penalty appeals by conducting office and field investigations 
on assessed penalties to ensure compliance with the Fire Safety Act, 
Codes, and Regulations.

Appeals where a resolution cannot be reached, prepare case for Office 
of Administrative Law

Prepare files and necessary documents for the division’s Regulatory 
Officer to have judgement request sent to Superior Court

Verify that state owned, leased, or occupied buildings that containing a 
Life Hazard Use are properly registered in accordance to the Fire Safety 
Act, Codes, and Regulations

Properly update state owned, leased, or occupied buildings containing a 
Life Hazard Use in the division’s Registration and Inspection Management 
System (RIMS)

Investigate cases of suspended bills and make necessary changes in the 
division’s Registration and Inspection Management System (RIMS)

Perform field and office investigations on Fire Protection Contractors to 
ensure they are in compliance with and follow all the requirements of the 
Fire Safety Act, Codes, and  Regulations

Where violations of the Fire Protection Contractor requirements are found, 
works with office staff to prepare case for proper sanctions. This includes 
representing the division at Office of Administrative Law

Conduct investigations for suspected violations of the division’s training 
regulations.

Where it is found that the division’s training regulations were not properly 
followed, prepares case for issuance of penalties and/or sanctions against 
a fire service instructor, fire official, or training organization 

Investigate possible violations for the Fire Service Deployment Act and 
prepare cases as warranted for appropriate sanctions

NOTE:  The following are for positions assigned to the Department 
of Labor and Workforce Development:

Interprets the New Jersey Crane License laws and regulations and 
Asbestos laws and regulations.

Conducts onsite inspections to ensure compliance with the Asbestos 
laws and regulations and Crane laws and regulations.  Issues violations 
as required.  

REQUIREMENTS:

EXPERIENCE:

Seven (7) years of experience involving the research, interpretation 
or application of administrative codes, statutes and/or technical codes 
of a governmental regulatory program.

NOTE:  A Bachelor's degree may be substituted for four (4) years 
of experience as indicated above.

NOTE:  A Master’s degree in Engineering, Planning, or Architecture 
may be substituted for five (5) years of experience as indicated above.  

NOTE:  Within the Division of Fire Safety, a Master's degree in
Fire Science may be substituted for five (5) years of experience as 
indicated above.

CERTIFICATION:

The following is for positions assigned to the Division of Fire Safety, 
Department of Community Affairs: 

Applicants  must possess a Fire Official Certification issued by the 
Division of Fire Safety, Department of Community Affairs.     

LICENSE:

Appointees will be required to possess a driver's license in New Jersey 
only if the operation of a vehicle, rather than employee mobility, is necessary 
to perform the essential duties of the position.

KNOWLEDGE AND ABILITIES:

Knowledge of the methods used to conduct inspections and investigations.

Knowledge of the methods used to gather, review and evaluate information.

Knowledge of the factors to be considered in identifying cases of 
non-compliance.

Knowledge of the methods used to assess administrative penalties.

Ability to interpret laws, rules and regulations, apply them to specific 
situations, and explain them to affected individuals.

Ability to conduct inspections and investigations.

Ability to gather and compile information and documentation, and review 
and evaluate documents and files.

Ability to identify and evaluate cases of non-compliance.

Ability to coordinate enforcement efforts with other agencies.

Ability to determine and establish abatement schedules and extensions.

Ability to establish and maintain cooperative working relationships with 
those interested or involved in the work of the unit.

Ability to appear as a witness and provide testimony in court

Ability to speak before groups.

Ability to establish and maintain records and files.

NOTE: The following are for positions assigned to the Department of 
Labor and Workforce Development.

Knowledge of the Federal and State Crane and Asbestos laws 
and Appropriate regulations.

Knowledge of Crane Operator licensing procedures.

Ability to operate digital photographic equipment for the gathering
and documenting inspection information.

Ability to read, write, speak, understand or communicate in English 
sufficiently to perform the duties of the position. American Sign 
Language or Braille may also be considered as acceptable forms 
of communication.
