COMPLIANCE OFFICER 2 MVC

DEFINITION:

Under the general direction of a Compliance Officer Supervisor or other supervisory official in the Motor Vehicle Commission, is responsible for taking the lead in conducting audits of Motor Vehicle operations incorporating agencies and inspection stations (including Driver Testing operations); has responsibility for taking the lead in conducting investigations on rules, regulations, and procedures pertinent to private inspection facilities, centralized inspection facilities, mobile inspections, motor vehicle agencies, school bus operators and other related businesses licensed/regulated by the Motor Vehicle Commission; serves as the subject matter expert in the technical compliance, enforcement, investigative and inspection activities of the Motor Vehicle Commission; does other related work as required.

EXAMPLES OF WORK:

Takes the lead in conducting the more difficult overt (scheduled) and covert (undercover) audits/investigations at MVC agencies, private inspection facilities (PIF) and centralized inspection stations (Parsons) including Heavy-Duty diesel locations, and school bus operators and locations to ensure compliance with state laws, regulations, policies, and procedures.

Proficient in the technical compliance, enforcement, investigative and inspection activities of the Motor Vehicle Commission. 

Investigates complaints from customers, law enforcement agencies, municipalities, business competitors, anonymous tipsters, and other interested parties.   

Reviews and analyzes statistical information to detect trends.

Audits MVC controlled documents such as blank titles, registrations, permits, temporary license plates, inspections stickers, etc. 

As required, supports lower-level Compliance Officer staff in the more difficult audits/investigations.

Will be required to learn new, revised, and amended compliance procedures as required by the Motor Vehicle Commission.

Provides advice and guidance to business owners, operators, customers, MVC employees and other individuals to ensure compliance with Motor Vehicle rules, regulations, and procedures.

Conducts preliminary research in preparation for audits/investigations.

Responds to emergency situations and/or public complaints from customers, media, police, and others.  

May serve disciplinary notices, suspension orders or written violations.

Conducts and takes the lead in follow-up visits to ensure compliance with MVC rules, regulations, and procedures. 

Coordinates internal investigations of lower-level Compliance Officer staff (example: Bribes).

May act as a witness to testify for the State before a Grand Jury, court of law, administrative hearing, or other judicial body as required.

May conduct hearings.

Takes the lead in training and assigning work to lower-level Compliance officer staff.

Provides input to supervisors regarding employee performance.

Reviews and analyzes operational audits and statistical reports based upon division operating procedures and directives.

Monitors the overall agency operation and observes the business workflow to ensure compliance with Title 39 and MVC rules, regulations, and procedures.

Ensures titles, licenses, permits, and registrations are being processed according to MVC rules, regulations, and procedures.

Ensures the authenticity of out-of-state titles and other driving documents.

Observes employees to ensure the proper filing of MVC documents.

Conducts weekly and monthly audits of ledgers and work procedures to verify that the number of documents and materials present at an agency correspond to the records of agency documents issued and services rendered. 

Supports the agency manager in the operation of the agency in accordance with MVC rules, regulations and procedures.

May review lower-level Compliance Officer employee time sheets for accuracy and completeness.

Ensures driver license (DL) and commercial driver license (CDL) tests procedures are being followed.

Performs safety checks.

Rotates regions every 3-6 months to help maintain consistency between the agencies.

Ensures school bus operators are compliant with MVC rules, regulations and procedures.

Ensures that buses are inspected, insured, and the drivers have the appropriate license to operate a school bus.

Investigates school bus accidents to ensure MVC rules, regulations, and procedures are being followed.

Takes the lead over Safety Specialists in the inspection of school buses and special projects (Compliance officers in this unit are licensed State inspectors).

Investigates non-conforming school buses and prepares reports that may lead to fines, suspensions, or hearings for alleged violators.

May issue summons to school bus operators in violation of MVC rules, regulations, and/or procedures.

May audit and/or maintain driving records for school bus company employees.

Visits private inspection facilities to ensure proper business procedures are being followed (example: hours of operation, visible license, accurate prices, etc.).

Reviews and analyzes MVC inspection statistics; takes appropriate action based on findings.

Provides technical support to private inspection facilities as required.

Performs background checks and takes the lead in the initial set-up of Inspection facilities.

May issue suspension of inspection license.

May take the lead over Safety Specialists regarding mobile inspection procedures (Compliance officers in this unit must be licensed State inspectors).

Performs semi-annual fixed asset inventories for MVC equipment and inspection stickers.

Observes private and centralized inspection centers from afar (example: monitoring the number of cars entering and exiting the facility). 

Works in conjunction with State police and municipalities regarding taxi inspections.

Performs random parking lot surveys to ensure vehicles have valid and current inspection stickers.

Prepares clear, sound, accurate, and informative reports containing findings, conclusions, and recommendations.

Takes the lead in the maintenance of essential records and files.

Will be required to learn how to utilize various types of electronic and/or manual recording and computerized information systems used by the agency, office, or related units.

REQUIREMENTS:

EDUCATION:

Graduation from an accredited college with an Associate's degree or successful completion of sixty (60) semester hour credits.

NOTE: Applicants who do not possess an Associate's degree or have the required semester hour credits, may substitute additional experience as stated below on a year-for-year basis. Thirty (30) semester hour credits are equal to one (1) year of experience.

EXPERIENCE:

Two (2) years of experience in a governmental or private organization involving the review and analysis of varied operations to determine compliance with existing laws, rules, regulations, or procedures.

NOTE: Appointees must successfully complete training in all the following areas: Inspector License Training, Agency Business Process Training and Document Fraud Training.

NOTE: School Bus Operations unit only - Appointees may be required to successfully complete the required training and obtain certification necessary to inspect school buses. 

LICENSE:

Appointee will be required to possess a driver's license valid in New Jersey only if the operation of a vehicle, rather than employee mobility, is necessary to perform the essential duties of the position.

KNOWLEDGE AND ABILITIES:

Knowledge of motor vehicle laws, rules and regulations and their application.

Knowledge of the methods used to gather and analyze data.

Knowledge of the methods used to conduct inspections and investigations.

Ability to apply state, local, and federal laws, rules, regulations, and administrative codes to specific policies, procedures, compliance and enforcement programs, standards of regulatory control and compliance, civil, administrative and criminal violations relating to the licensing of various businesses that are regulated by the Motor Vehicle Commission including: private inspection facilities, centralized inspection facilities, MVC agencies, bus operators, etc.

Ability to understand the types of conduct that would legally constitute negligence, abuse/neglect, or willful misconduct under the regulatory enforcement of the assigned unit.

Ability to prepare clear, sound, accurate and informative statistical reports of field investigations, containing findings, conclusions and recommendations.

Ability to organize and make field visits, conduct investigations with accurate observations of records and conditions, detect abstract violations and notate significant facts and conditions and prepare reports.

Ability to take the lead over and train lower-level Compliance Officers.

Ability to analyze and interpret accounting/financial statements or similar records.

Ability to act as a witness in court and give testimony under oath in administrative hearings, state and federal courts or other judicial bodies as may be required.

Ability to conduct hearings.

Ability to provide advice to Motor Vehicle Commission staff and to businesses in emergency situations.

Ability to respond and investigate emergencies, public complaints, and make adjustments where possible, and prepare reports.

Ability to organize work assignments of staff and provide instruction.

Ability to understand and apply modern investigative techniques and procedures.

Ability to understand the problems associated with planning, scheduling, and organizing of work programs.

Ability to establish and maintain cooperative working relationships with individuals, agencies, and groups in the public and private sector. Ability to assist in developing, maintaining, and using files and record keeping systems.

Ability to learn how to utilize various types of electronic and/or manual recording and information systems used by the agency, office, or related units.

Ability to read, write, speak, understand and communicate in English sufficiently to perform the duties of this position. American Sign Language or Braille may also be considered as acceptable forms of communication.
